Definitions

These Terms and Conditions of Sale (hereinafter “T&Cs”) are provided by CHAMADE, a company registered with the Trade and Companies Register under number 899 646 145, with headquarters located at 40/42 rue Laugier - 75017 PARIS, France, VAT number FR68899646145 (hereinafter referred to as “CHAMADE”).

For the purpose of these Terms:
- “Site”: the website https://www.chamade.paris and all of its pages.
- “Products” or “Services”: any physical goods and services available for purchase or subscription on the Site.
- “Seller”: CHAMADE, whether acting as a legal or natural person, offering its Products or Services via the Site.
- “Client”: any user, individual or professional, purchasing Products or Services through the Site.
- “Consumer”: as defined in the preliminary article of the French Consumer Code, “any individual acting for purposes that do not fall within the scope of their commercial, industrial, artisanal, or liberal professional activity.”

Visitors interested in CHAMADE's Products and Services are invited to carefully read these T&Cs, and to print or save them before placing an order.

By placing an order, the Client acknowledges having read and fully accepted these T&Cs without reservation.

Article 1 – Purpose and Scope

The Seller reserves the right to amend these T&Cs at any time by publishing a new version on the Site. The applicable version for the Client is the one in force at the time of ordering.

The Site provides information regarding its hosting, legal terms, privacy policy, and usage, all accessible through dedicated pages.

The Site offers online sales of knitting yarns and/or kits including, but not limited to: balls of yarn, knitting needles, printed or digital tutorials.

Use of the Site is free and open to all Clients. Placing an order implies full and unreserved acceptance of the T&Cs. This acceptance may be formalized, for example, by ticking the box that states, “I acknowledge having read and accepted the Terms and Conditions.”

The Client must be legally capable of accepting these terms. If the Client is a minor or lacks legal capacity, they confirm that they are authorized by a guardian or legal representative.

The Client accepts the evidential value of the Seller’s automated recording systems and waives the right to contest them unless proven otherwise.

A privacy policy is available and forms an integral part of these T&Cs.

Article 2 – Client Account

Creating an account is required to place orders. Clients must provide accurate personal information and update it as needed. They are responsible for the security of their login credentials and the use of their account.

The Seller may delete any account violating these T&Cs or inactive for over a year, without compensation.

Article 3 – Orders and Purchase Process

Clients can select Products, review them in their cart, and proceed to checkout. They must provide necessary information and agree to these T&Cs before payment. Confirmation is sent via email.

Ownership of Products transfers upon full payment.

Article 4 – Prices and Payment

Prices are in Euros, all taxes included. The applicable price is the one listed at the time of ordering. Payment can be made by credit card via a secure payment gateway. CHAMADE does not store payment data.

Invoices are archived as reliable, durable copies.

Article 5 – Delivery and Returns

5.1 Shipping & Returns

Delivery fees are communicated before payment and apply to mainland France. For other destinations, Clients must contact customer service.

If a Product is shipped outside the EU or to French overseas territories, the Client is considered the importer and must bear any applicable customs duties or import taxes.

The Seller will deliver within 30 days unless otherwise specified. The Client may refuse delivery if damage or discrepancies are noted and must do so in writing on the delivery slip. CHAMADE will not be liable if these steps are not followed.

Returned packages due to refusal or delivery failure may be resent at the Client’s expense.

In case of delivery errors, Products must be returned complete and in perfect condition. Damage due to mishandling by the Client will not be accepted.

5.2 Right of Withdrawal

Consumers have 14 calendar days from delivery to return any item for exchange or refund, except return shipping costs.

Returned items must be unused, in their original packaging, and complete. Items that are damaged, used, or incomplete will not be accepted.

The withdrawal can be requested via email at contact@chamade.paris. Some Products are not eligible for withdrawal under Article L.221-28 of the Consumer Code, including opened, customized, or perishable items.

5.3 Transfer of Risk to the Carrier Selected by the Client

In accordance with Article L.216-5 of the French Consumer Code, when the Client personally selects a carrier for delivery of the order, responsibility for the goods transfers to the Client as soon as the package is handed over to the carrier.

From that moment, any risk of loss, theft, damage or delay falls exclusively on the Client. In the event of a dispute or non-delivery, it is the Client’s responsibility to contact the chosen carrier directly to initiate any claim or refund procedure.

CHAMADE shall not be held liable for any delivery failure, delay, or lost package once the order has been handed over to the Client’s selected carrier.

Article 6 – Product Warranty

Products are covered by:
- Legal Warranty of Conformity: valid for 2 years from delivery.
- Warranty Against Hidden Defects: valid for 2 years from the discovery of the defect.

Claims must be made by email or post. In case of non-conformity, the Product may be exchanged or refunded. Return shipping costs are covered by CHAMADE.

Article 7 – Customer Service

Customer support is available at contact@chamade.paris or via postal mail as indicated in the legal notice.

Article 8 – Liability

CHAMADE is not liable for disruptions due to force majeure or indirect damages such as loss of profit, data, or business.

Clients use the Site at their own risk. CHAMADE is not liable for external links, ads, or outdated Product visuals.

Article 9 – Intellectual Property

All elements on the Site are owned by CHAMADE or used with permission. Unauthorized use or reproduction is strictly forbidden and may lead to legal action.

Article 10 – Severability

If a clause of the T&Cs is found invalid, the rest remains enforceable. These T&Cs supersede all prior agreements.

All correspondence must be in French.

Article 11 – Governing Law and Mediation

These T&Cs are governed by French law. Disputes may be submitted to the Site’s publisher for amicable resolution before legal action is taken.
